Update on Visa Conditions 8107, 8607, and 8608

Effective from 1 July 2024, Australia’s visa conditions 8107, 8607, and 8608 have been revised to strengthen worker protection and productivity in line with the Migration Strategy.

Key Changes to Visa Conditions 8107, 8607, 8608:

  • Extended Transition Period: Visa holders (subclass 457, 482, 494) who cease employment with their sponsor now have:
    • Up to 180 days at a time, or
    • A maximum of 365 days over the visa period to find new sponsorship, apply for another visa, or depart Australia.
  • Flexibility in Employment: During this transition, visa holders can work for other employers, including roles not in their initial sponsorship nomination.
  • Compliance Requirements: Sponsors must notify the Department of Home Affairs of any changes within 28 days, including ceasing sponsorship or a visa holder’s resignation.
  • Regulatory Adherence: Visa holders must comply with their nominated occupation’s requirements, including necessary licenses or registrations.

Visa holders are prohibited from engaging in any employment that contradicts the licensing or registration requirements of their designated occupation. This encompasses any conditions or stipulations they are bound by.

Application:

These changes affect individuals holding existing visas and those granted visas on or after July 1, 2024. Periods when a visa holder was not employed by their sponsor before July 1, 2024, will not be considered when calculating the new timeframes.
